Affects of Popular Culture on Todays Generation Essays

People today blame popular culture for the â€Å"corrupting† of today’s generation. Many Americans do not think of the other factors that go into popular culture. There are in fact many factors that go into the things such as teen pregnancy, education failure, and violence of today’s youth. Factors such as money, home life, and enviorment. Not only do Americans feel popular culture is to blame, but also feels popular culture is having its affect too soon. Absorption and Variable Costing, Inventory Management Free Essays

Absorption and Variable costing are very important tools for cost accounting. Both of these costing methods allow you to see the cost of your inventory, in a different way. For example the absorption method allows you to assign all costs to the product, while variable costing allows only variable costs to be assigned to the product. Throughout this paper I will discuss the importance of both costing methods, how it is implemented as well as using the income statement for costing. Most companies don’t necessarily look at the costs of all departments; they break down the departments into separate entity’s called profit centers. The companies do this because by breaking down each department they can see if there are any problem areas that they should correct, involving the performance of the individual profit centers. To look at the overall company’s performance, most people find it useful to look at the income statement. However, this income statement is of little use for determining the viability of the individual business units or segments. Instead, it is important to develop a segmented income statement for each profit center. That is why these two costing methods have been developed. One of them is based on variable costing and the other is based on absorption costing. They are costing methods because they refer to the way in which product costs are determined. Product costs are inventoried; and they include direct materials, direct labor and overhead. Period costs are expensed in the period they are incurred. These are usually selling and administrative expenses or other expenses to run your company day to day. The one difference between the two costing systems is fixed factory overhead. Absorption costing is a costing system that assigns all manufacturing cost to the produce, including fixed factory overhead. Absorption costing includes direct materials, direct labor, variable overhead, and fixed overhead. The four costs define the cost of the product. Under absorption costing, fixed overhead is viewed as a product cost, not a period cost. Fixed overhead is assigned to the product through the use of predetermined fixed overhead rate and is not expensed until the product is sold. Absorption costing has product costs of direct materials, direct labor, variable overhead, and fixed overhead. While the period costs include just selling and administrative expenses. Variable costing assigns only the variable manufacturing costs to the product; these costs include direct materials, direct labor, and variable overhead. As you can see variable costing stresses the difference between fixed and variable manufacturing costs. Fixed overhead is than treated as a period expense and is excluded from the product cost. The reason for this is because fixed overhead is a cost of staying in business. After the period is over, any benefits provided by this capacity are expired and are not inventoried. Fixed overhead of any period is than seen as expiring in that period and is charged in total against revenues for the period. The product costs for variable costing include direct materials, direct labor and variable overhead. The period costs include fixed overhead, and selling and administrative expenses. Now we move onto the relationship between the variable costing income and the absorption costing income. The relationship changes as the production and the sales change. If you sold more than was produced, variable costing income is greater than the absorption costing income. But if you sold more than you produced that would mean that you were selling the beginning inventory and units produced. Under the absorption method, the units that are coming out of the inventory have the fixed overhead from the period attached to the inventory. So the amount of the fixed overhead expensed by absorption costing is greater than what the current period’s fixed overhead by the amount of fixed overhead flowing out of the inventory. The variable costing income is greater than the absorption costing by the amount of fixed overhead coming out of the beginning inventory from the current period. But if the production and the sales are equal than there is no difference between the two reported incomes. The income relationship is consider to be that if production is greater than sales than the absorption income is reater than the variable income. But if the production is less than the sales than the absorption income is less than the variable income. So than if the production equals the sales than the absorption income is also equal to the variable income. The differences between the absorption and variable costing are the recognition of when the expenses are occurred. The recognition of the expenses associated with the fixed fa ctory overhead. With the absorption costing, the fixed factory will than be assigned to the units produced. This actually presents two problems, first, how do we convert the factory overhead applied on the basis of direct labor hours or the machine hours into factory overhead applied to the units produced? Also, what is than done when actual factory overhead does not equal applied factory overhead? Now we move onto the variable costing and the segmented income statements. The variable costing is a useful tool in preparing a segmented income statement because it gives us useful information on the variable and fixed expenses. A segment can be considered a division, department, product lines, customers class among other things. In the segmented income statements, the fixed expenses are broken down into two categories; direct fixed expenses and the common fixed expenses. The additional subdivision highlights controllable versus the non-controllable costs and than enhances the manager’s ability to evaluate each segment’s contribution to the overall firms performance. The direct fixed expenses are the fixed expenses that are directly traceable to a segment. They are sometimes referred to as avoidable fixed expenses, because they disappear if the segment is eliminated. Two or more segments jointly cause common fixed expenses. These expenses persist even if one of the segments to which they are common is eliminated. The segment margin is a profit contribution that each segment makes toward covering a firm’s common fixed costs. The segment should be at least able to cover both of its own variable costs and direct fixed costs. A negative segment margin drags the firm’s total profit down. Segment income statements are useful in management decision-making. The reason so is so that you can run your company at the most efficient level, while raising your profit margin. This is a very interesting topic because it helps show the importance of inventory control and how it affects your operating income. The inventory management is very key to a company. The reason for this is because when your costs are to high and your profit margin is too low than there is probably a reason of your inventory being to high or the overhead being to high. The stress of inventory management cannot be understated for many companies but especially manufacturing companies. Apart from the product cost of the inventory, there are other types of costs that relate to inventories of raw materials, work in process, and the finished goods. Inventory must be bought, received, stored, and moved. The inventory related costs include the demand for a product that is known with near certainty for a period of time. Two major costs are usually associated with this, if the inventory is purchased from an outside source, then the costs are referred to as ordering costs and carrying costs. If the product is produced internally, then the costs are called setup costs and carrying costs. Ordering costs are the costs to place and receive the order. Carrying costs are costs of keeping the inventory in your warehouse or store. There also can be a third categories, which includes stock out costs, which are the costs of not having a product available when demanded by the customer or the cost of not having a raw material available when needed for production. A company that uses these types of costing methods will definitely have a better grasp of the costs associated with their products. This will help a company become more efficient and have a better idea of which product is making the most money and which product is making the least amount of money. Yet again, this is not used for your company as a whole usually but it is used for each product individually. So if I had a red yoyo and a green yoyo and was selling a lot of each and equal than I would break them down individually between red and green and possibly see that the green yoyo is more expensive a product and therefore I would either have to sell it at a higher prices (even though it is exactly the same product except the color), or I would have to stop selling the green yoyo and just sell the red yoyo. In order to run any type of company a manager must show extreme care to the inventory management, because you can have the best selling product on the market but if your not efficient enough with your inventory than you may put a huge damper on the future of your company and not allow your company to grow properly. Donne doesnt necessarily use the pleasure of being with a woman to how he would feel if joined with God, but instead he uses as a way to God. If sex is an ecstasy and mortal act that it is so great then spiritual ecstasy may feel even greater. This metaphor is important because Donne can easily relate. Invention of Polystyrene and Styrofoam Polystyrene is a strong plastic created from erethylene and benzine. It can be injected, extruded or blow molded. This makes it a very useful and versatile manufacturing material.   Most of us recognize polystyrene in the form of styrofoam used for beverage cups and packaging peanuts. However, polystyrene is also used as a building material, with electrical appliances (light switches and plates) and in other household items. However, he did not know what he had discovered.  It took another organic chemist named Hermann Staudinger to realize that Simons discovery, comprised of long chains of styrene molecules, was a plastic polymer. In 1922, Staudinger published his theories on polymers. They stated that natural rubbers were made up of long repetitive chains of monomers that gave rubber its elasticity. He went on to write that the materials manufactured by the thermal processing of styrene were similar to rubber. They were the high polymers, including polystyrene. In 1953, Staudinger won the Nobel Prize for Chemistry for his research. BASF Commercial Use of Polystyrene Badische Anilin Soda-Fabrik or BASF was founded in 1861. BASF has a long history of being innovative due to having invented synthetic coal tar dyes, ammonia, nitrogenous fertilizers as well as developing polystyrene, PVC, magnetic tape and synthetic rubber. In 1930, the scientists at BASF developed a way to commercially manufacture polystyrene. A company called I.G. Farben is often listed as the developer of polystyrene because BASF was under trust to I G. Farben in 1930. In 1937, the Dow Chemical company introduced polystyrene products to the U.S. market. What we commonly call styrofoam, is actually the most recognizable form of foam polystyrene packaging. Styrofoam is the trademark of the Dow Chemical Company while the technical name of the product is foamed polystyrene. Ray McIntire - Styrofoam Inventor Dow Chemical Company scientist  Ray McIntire invented foamed polystyrene aka Styrofoam. McIntire said his invention of foamed polystyrene was purely accidental. His invention came about as he was trying to find a flexible electrical insulator around the time of World War II. Polystyrene, which already had been invented, was a good insulator but too brittle. McIntire tried to make a new rubber-like polymer by combining styrene with a volatile liquid called isobutylene  under pressure. The result was a foam polystyrene with bubble and was 30 times lighter than regular polystyrene. The Dow Chemical Company introduced Styrofoam products to the United State in 1954. How Are Foamed Polystyrene or Styrofoam Products Made? Foamed polystyrene starts as small spherical beads that contain an expanding agent called hydrocarbon.The polystyrene beads are heated with steam. As the expanding agent boils, the beads soften and expand up to forty times their original size.The expanded beads are left to cool down before being heated again. However, this time the beads are expanded within a mold.The molds are designed in a variety of  shapes  depending on the desired end product.  Examples are things such as styrofoam  cups, cartons, wig stands and more.The beads completely fill the mold and also fuse together.Styrofoam is about 98% percent air.

Visitors can light candles or visit an eternal flame in silence homage to the departed souls. In the Hall of Remembrance, even the air feels heavy with the weight of history. Before you actually come to visit the place, the reality of the Holocaust and the fact that these people actually lived, laughed, cried and loved does not actually sink in. Sitting in contemplation in the Hall of Remembrance, you are made aware of the fact that every single name on display was a living, breathing human being, with dreams, hopes, and aspirations. The USHMM was built not just as a memorial to the victims of the Holocaust. It was also construct ed to familiarize newer generations with the horror and futility of war. It was meant to pass on the message that hatred should not be allowed to prosper. And I must confess it did have this effect on me. A visit to USHMM is not just about learning about this calamity. The place helps one connect with their innermost feelings of compassion, sympathy, and empathy.

How did the foreign media negatively and positively affect the events Essay Tiananmen Square in 1989 refers to the pro-democracy protests that took place against the communist regime in the People’s Republic of China between May and June 1989 (Gilboa 200). As has been the practice, flow of information in China is always limited. That is why the foreign media played a very significant role in Tiananmen Square; in fact up to today, the incident is referred to as the Tiananmen Square Massacre in most of the outside world while it is simply referred to as the June Fourth Incident (Gilboa 200). Foreign media therefore played a big role in bringing the event out to the world; and this had many positive as well as negative impacts on the outcome of Tiananmen Square. There have been a lot of controversies surrounding Tiananmen Square. Even up to today, the number of people who died in the riots is still established. The impact of the media started being felt early on in April when after the death of reformist leader, Former Chinese Communist Party chief Hu Yaobang, University students from Beijing started putting up posters in his praise while advocating for freedom, democracy and the rule of law (Gilboa 200). The Chinese communist regime was largely anti-reformist, and this political activism was not to be received in kind. Having strict media and information censorship policies, this event would not have captured the audience it did, thanks to foreign media (BBC, 2010). Foreign media thus fuelled the intensity of the riots and the resolution of the demonstrators. If it was not for the foreign media, the events that transpired during the Tiananmen Square riots would not have been known outside the borders of communist China (Fenby 2008). But reporters from foreign media houses transmitted news feeds live from the scene and brought the cause of the demonstrators to the whole world. People, governments and human rights activists where then able to know how the situation was in China, and there was increased pressure on the communist regime ruling in China to grant its subjects the basic rights and freedoms (Gilboa 200). The brute force with which the government descended on the demonstrators even made the then president of the United States, George Bush, to halt any further trade in arms between the U.  S and the People’s Republic of China. Foreign media, being largely biased towards democracy and other western ideals, amplified the events occurring at Tiananmen Square and therefore gave the movements a lot of momentum (BBC 2010). Even when the government intervened with a brute force whose actual destruction of life is still not clearly established, the student protestors stayed put, buoyed by the support of the foreign media. It can thus be said that foreign media played a role in the total number of fatalities that actually occurred as a result of the Tiananmen Square Riots of 1989 (Fenby, 2008). Through deliberate exaggeration, the foreign media reports working on the Tiananmen Square story fueled international tensions further. Many western nations including the United States and most of the countries in Western and Eastern Europe condemned how the Chinese government was approaching the Tiananmen Square riots and questioned its human rights records (Richelson, Evans 1999). Many other nations in North America, Latin America and Oceania also condemned the Chinese communist regime. India, which had been on a collision course with the people’s republic of China, advised her local media houses to censor the content streaming in from Beijing to prevent a possible escalation of tensions between the two countries (Gilboa 200). In fact, media exaggeration in some way altered the international political landscape. Citizens in communist countries became wary of what the communist juggernaut would do to them. Elections were due to be held on the 4th of June in Poland, where the Polish Communist Party was in rule. This was just hours after the Tiananmen Square massacre but the polish public voted overwhelmingly in favor of leftist politicians, starting a process that would eventually remove the Polish Communist Party from power a year later. The United Nations and other human rights watchdogs had their attention attracted by foreign media coverage of what was actually happening in Tiananmen Square (Gilboa 200). The then Secretary General of the United Nations, Javier Perez de Cuellar, called on the Chinese government to practice maximum restraint while handling the rioters and hunger strikers on Tiananmen Square while the European Economic Community cancelled all high profile dealings with the Chinese in protest of the violation of human rights that was being orchestrated by the Chinese government on her citizens (Richelson, Evans 1999). In conclusion, the effect of foreign media in covering the events of Tiananmen Square in 1989 had more positive effects that negative effects. The plight of the Chinese people was brought to the fore leading to increased concern and measures to force the Chinese government to respect rights and freedoms that are internationally recognized as being universal and unalienable to every person. However, much of the information broadcast by several media houses was inaccurate and this led to misunderstandings and tensions between the Chinese government and several other authorities.

The Divine Comedy - Heaven or Hell?      Ã‚  Ã‚  Ã‚  Ã‚   The character of Dante in The Divine Comedy who descended into the inferno caused me to stop and think about this awful place.   As the reader I got to take an imaginary journey with Dante to a horrible place where I do not care about going.   While Dante descended into hell I plan on ascending into heaven someday.   Dante had a choice to make whether or not to get back on the right path.   It came down to heaven or hell - choose.      Ã‚  Ã‚  Ã‚  Ã‚   I think it was willed for Dante to see this place while he was still living.   By seeing hell while he was alive Dante could be sure and make the right choices to find his way back to the straight path.   Being on the right path in his lifetime would ensure he would not spend eternity in such a miserable place.   I believe the whole purpose of this journey into hell was to let Dante see the anguish there and choose.   Perhaps this was a divine warning. In Canto 2, Beatrice, the symbol of Divine Love, an angelic spirit was sent to help aid Dante   from his error and help him return back.   This is purely love and compassion at its best.   Sending someone into hell to rescue another person out of there. Great lengths were taken to help Dante return back to the straight way.   I do not believe such action was taken if Dante was to end up in hell all along.      Ã‚  Ã‚  Ã‚  Ã‚   For some reason midway in Dante's life's journey he had gone astray and at this point was searching for answers.   I guess hell was as good a place to start the search as any place.   Ã‚  Something for sure had led him astray and Dante was going to find out what it was.   Strange as it may seem Dante did find the answers he was looking for in hell.      Ã‚  Ã‚  Ã‚  Ã‚   Dante had entered into an awful place full of darkness and evil.   Dante did not realize to return back would not be easy, the Leopard stood blocking him every turn to keep him from getting back.   As a Christian I could relate to this.

Native American view of the European The Native American’s culture was extremely different from the culture of the Europeans. Both had different traditions and way of life, everything from the clothing they wore, the food that they ate and the different gods that they worship. All was an influence from how they have adapted to their environment and to the other people around them. The very foundation of both cultures was so distinctive that war and chaos was sure to come. Throughout history war and conflict had been started over things such as skin color, religion and way of living, all because both side had a different culture or beliefs. That the difference in the culture was what started the demise of the Native American. The culture of the Native American was inferior to the Europeans, in that they didn’t have the knowledge in science and the advance in weaponry that gave the European an advantage over them. â€Å"The white men despise and cheat the Indians† (Tecumseh 557). That they kept taking advantage of the Indians kindness and took more and more of the Indians’ lands until they had taken over the whole country. Forcing the Indians onto reservation and limited their movement to that amount of space. This later cause some of the settlers to have fear the Indians as they saw them moving about following the buffalo and other herds of animals they use as their food supply. They view the Indians as a threat and try to keep them under control by forcing them into further west toward the Great Plains where they were not use to the terrain and the surrounding. Everything the Native American did was from what they had known from their way of life. The European had wars with other countries for territory and power. That all over Europe countries were finding and grabbing colonies to find gold and gain more power over the surrounding countries. There was no different with the land that the Native American had. While the Native American only fought wars if they had a conflict that could not be resolve any other way. That the Native American â€Å"cultivates peace at home, and promotes†¦ happiness† (Ganter). The Native American had no knowledge of the world beyond their borders. That seeing the white men causes them to be in awe for they had never seen anyone beside other tribes. Both sides had their own was of  interacting with the other. The first contact they had with each other later affect how their relationship was going to be. The Native America chose to â€Å"shared freely with [the European] whatever the Great Sprit had given† (Tecumseh 556) them. That the â€Å"different complexions and different customs† (Red Jacket 554) meant nothing as they saw other men in need of aid and guidance of how to survive in such a place. The European â€Å"were ready to perish in the wilderness† (Bradford 53) if the Native American have not come to their aid. That the European had accepted the aid and then turn on the generous people that had helped them in a world completely new to them. That later the European became a â€Å"poisonous snake†¦and they sting their benefactor to death† (Tecumseh 556). That the European took advantage over the kind Native American that had greeted them with welcome and had help them in their first year in the wilderness. A major factor in the destruction of the Native Americans was their different belief and way of worship. The European looks down on the Native American polytheist religion. Also the way they worship by dancing and doing their powaws. The Native American were being force to convert to Christianity by the Europeans. The Native Americans question the European way of thinking. The European has escape from their native country to â€Å"enjoy their religion† (Red Jacket 554) and have religious freedom. Then why are you trying to force the Native Americans to covert? Are you not acting like those who have oppressed your back in your native land? The Europeans idea of religion was skewed and imperfect in the eyes of the Native Americans. That there was â€Å"one religion, why do you white people differ so much† (Red Jacket 554). The variation in the religion of the European was odd and inconsistent. There was dispute amount them in which of their beliefs was better, even if the different was over a small detail. That all the Native Americans â€Å"never quarrel about religion† (Red Jacket 554) and have live in perfect harmony. That the great being above have given each of his children a â€Å"different religion according to [their] understanding† (Red Jacket 555). The Native American is happy as they are and tells the Europeans that they have their religious freedom and should be happy with what they have. Not all Native Americans view the European in the same way. That most view them as â€Å"poisonous snake† (Tecumseh 556) that would attack the person closest to them. Tecumseh wanted all the Native Americans to rally together and fight all the Europeans to get back  what is rightful their. He wanted to defeat all the European before they all fall, like their ancestor did. They must take action before it is too late to do anything that will ensure their survival. That the difference in the two cultures may have led to some problems that almost lead to the complete destruction of the Native Americans. Obesity †Nutrition Essay

Fast food is something that every American knows about. Most likely you, the person reading this has had fast food before, and probably enjoyed it. Whether it may be Mcdonalds, Burger King, Taco Bell, Jack in the Box, KFC, etc. There is nothing as cheap, quick to get, and tasty as fast food. With the ever-growing population of obese Americans, people are looking for a reason and for most that reason is fast food. Now according to the CDC (centers for disease control) the definition of overweight is having a BMI (body mass index) of 25-29. 9 and the BMI for an obese person is 30 or higher. Could it be that fast food is causing 78 million Americans 20 years or older to be obese, or that 17% of all children and teens in the US are over weight because of it? I think not. Sure, fast food may not be the healthiest choice for you, but seriously, no one is forcing you to eat that cheeseburger and no one is forcing you to drink that soda. You see fast food is not the problem, the decision making of the obese American population is. Now just so we’re clear I have nothing against obese people and there is a big difference between a little chunky, which is okay and obese. Now just so your aware of the obesity problem here in America, here’s some cold hard facts about obesity. Here in the US more than 35% of adults are considered obese, that’s more than 78 million people across the country that are obese. Seventeen percent of children and young adults are obese, which is triple the rate of a generation ago. Studies have shown that obesity gives you a greater chance of getting type2 diabetes and even cancer. If you are wondering why there are so many obese people in America today just ask your self a few simple questions. Would you rather go for a nice evening jog or stay home and watch your favorite TV show? Would you rather eat a salad or something not as healthy like a burger or pizza? And finally would you rather go to the gym or hang out with friends? If I had to guess I’d say most of you would rather hang out with friends, eat junk food, and watch your favorite TV show. You see most people have the time to work out and eat right they just choose not to and just like every choice made in life it comes with it’s benefits and consequences. You don’t have to pay for a gym member ship just walk up some steps or play catch with your kids or take a walk at the park, anything is obviously better than nothing. Now researchers will argue against my claims, and that’s understandable. They’ll mention that 33 percent of children and adolescents in the U. S. consume fast food on a typical day; they’ll also state that on average adolescents will visit a fast food restaurant twice a week. Well all I have to say to that is whose fault is that? How are these kids buying the fast food? With their parent’s money of course. Why can’t the parents make them something healthy and control what there kids eat instead of giving them money to eat fast food? It’s the parent’s fault that the kids are eating fast food so often. Fast food isn’t going to make you obese unless you eat it most of the time. If you eat it occasionally but you also eat your fruits and vegetables you’ll be fine. It is crazy to know that in the U. S. 49% of money spent on food is spent away from home. Which means people are choosing to buy food from restaurants and other places rather than go to the grocery store and cook at home. That percentage is always increasing due to the fact that people now a days are looking for more convenient ways of getting there food. If your wondering just how much money is being spent on quick service restaurants, in 2011 quick service restaurants were expected to gain 168 billion dollars, 3% more than 2010. If people would just spend half the amount of money that they usually spend on fast food and cook a nice healthy meal instead there would be no problem with fast food. Once again the decisions of the American people are to blame. Hit the gym and help yourself get slim. Studies have shown that physical activity plays a big role in loosing weight but of course you knew that, its common sense. But what many people don’t know is that according to the CDC (center for disease control) fewer than 2 out of 10 Americans and less than 30 percent of adults get the recommended level of exercise. Also that more than 25% of U. S. adults do not devote any time to physical activity, the worst states being Louisiana, Alabama, Kentucky, Mississippi, Oklahoma, and Tennessee. It is very intriguing that correlations have shown that those states with the least amount of exercise have the most health problems. Type2 diabetes is mostly triggered by obesity, and in 1980 5. 5 million adults had it; now approximately 25. 6 million adults have type2 diabetes. The ever so increasing percentage of obesity and decreasing percentage in physical activity is definitely to blame. An interesting fact is that by loosing weight and getting from overweight to normal you can save on average $1400 a year on medication. If you don’t have time to hit the gym, there are a few tips that can help you get fit. First don’t drink soda; on average if you drink a soda can a day you’ll gain 15 pounds in a year, that is if you don’t work out of course. Take the stairs or walk around the block, a few extra steps could be the difference in burning some extra calories, and finally anything is better than nothing, curl some soup cans or do some crunches while watching TV. Any of those things can help you with your obesity, then you wont have to blame it on fast food. Fast food companies are now making a bigger push to serve healthier items in their stores, but it is up to the customers to get them otherwise it is all for nothing. McDonalds is taking the biggest step with there new items like the all fruit smoothies, apple slices, salads, and there brochures that show you there below 400,300,200, and 100 calorie items. Jack in the box is jumping on board as well with their 3 choices of salads, and serving grilled chicken instead of fried in there sandwiches. These fast food chains are realizing that healthy is the new way to go but yet the majority of people in America aren’t. We need to watch what we eat, eat healthier brown rice or bread instead of white, more fruits and veggies and less burgers, next time you go to mcdonalds get a salad instead of a Big Mac it might change your life. In conclusion the fast food industry is not to blame for Obesity in the United States of America. They’re taking steps in the right direction and the people of America should too. We need to start exercising more and getting active because that is the true reason for the increasing obesity. Marbury v. Madison, 1803 (Judicial Review) Marbury v Madison is considered by many to be not just a landmark case for the Supreme Court, but rather the landmark case.  The Courts decision was delivered in 1803 and continues to be invoked when cases involve the question of judicial review. It also marked the beginning of the Supreme Courts rise in power to a position equal to that of the legislative and executive branches of the federal government. In short, it was the first time the Supreme Court declared an act of Congress unconstitutional.   Fast Facts: Marbury v. However, several of these Midnight appointments were not delivered before Jefferson took office, and Jefferson promptly stopped their delivery as President. William Marbury was one of the justices who was expecting an appointment that had been withheld. Marbury filed a petition with the Supreme Court, asking it to issue a writ of mandamus that would require Secretary of State James Madison  to deliver the appointments. The Supreme Court, led by Chief Justice  John Marshall, denied the request, citing part of the Judiciary Act of 1789 as unconstitutional. Marshalls Decision On the surface, Marbury v. Madison was not a particularly important case, involving the appointment of one Federalist judge among many recently  commissioned. But Chief Justice Marshall (who had served as Secretary of State under Adams and was not necessarily a supporter of Jefferson) saw the case as an opportunity to assert the power of the judicial branch. If he could show that a congressional act was unconstitutional, he could position the Court as the supreme interpreter of the Constitution. And thats just what he did. The Courts decision actually declared that Marbury had a right to his appointment and that Jefferson had violated the law by ordering secretary Madison to withhold Marburys commission. But there was another question to answer: Whether or not the Court had the right to issue a writ of mandamus to secretary Madison. The Judiciary Act of 1789 presumably granted the Court the power to issue a writ, but Marshall argued that the Act, in this case, was unconstitutional. He declared that under Article III, Section 2 of the Constitution, the Court did not have original jurisdiction in this case, and therefore the Court did not have the power to issue a writ of mandamus.  Ã‚   Significance of Marbury v. Madison This historic court case established the concept of Judicial Review,  the ability of the Judiciary Branch to declare a law unconstitutional. This case brought the judicial branch of the government on a more even power basis with the legislative and executive branches. The Founding Fathers expected the branches of government to act as checks and balances on one another. The historic court case Marbury v. Madison accomplished this end, thereby setting the precedent for numerous historic decisions in the future.

Change the Culture of an Organisation Essay The culture of an organization can be defined by the ‘way they do things’, this means the way they make decisions, operate and how they choose and achieve their objectives. As culture is a set of values and practices, changing it may be difficult and a long process, especially if the change is organized by a new chief executive. Changing the culture of an organization may not be easy especially if the new chief executive does not fully understand the previous culture and therefore does not embrace it in the change. This lack of knowledge may result in an inappropriate culture being chosen that could limit the company’s performance as productivity reduces. An example of a badly imposed culture can been seen with the Chrysler and Damier-Benz merge in 1998. Damier-Benz imposed their traditional and structured German culture on the free-spirited American car company Chrysler. The extremely different cultures created tension that later affected their efficiency as decision-making took longer and the workforce were not happy. The inappropriate culture resulted in a loss of $1.5 billon by 2006. In 2011, the new chief executive of Tesco, Phillip Clarke, also made a cultural change which proved unsuccessful. He proposed a strategy to change Tesco’s brand image to be known for â€Å"highly valued brands† as opposed to their cheaper â€Å"Value† products. The decrease in popular promotion deals such as vouchers and meal deals reduced their sales revenue and share value which fell by 15% by the end of 2011. This suggests that Clarke failed to identify Tesco’s main source of competitively. Therefore, both examples show that cultural changes may be difficult as the new chief executives lack knowledge and experience in the company. Culture change also takes a long time, especially as traditions and values are set. A prime example of this is with Sony. Sony is a Japan-based company who prides themselves in adopting a traditional Japanese business culture. Examples of their culture can be seen with their clear line of authority and their strong belief in respect. However, Sony’s reducing performance and the fast changing world alarmed the new chief executive, Howard Stringer, to change the culture to one that embraces change. Although proposals to change the culture were made in 2007, Sony’s culture has still not fully transformed which is reflected in their still low competitively. Therefore, it may still take some time for Sony to fully embrace an innovative culture as their Japanese culture has largely influenced the organization. It also took a long time for Marks & Spencer to introduce higher levels of technology, such as a stock control system, as they are said to have a ‘backward culture’. This is because they don’t embrace change and are led by system and procedures. These examples provide evidence that change in a business’s culture may not be done quickly as the organization is accustomed to the previous culture. However, changing a company’s culture can be easy if the new chief executive conducts the change in an appropriate manner. As culture change will have a direct impact on stakeholders, it is important for the new chief executive to inform all stakeholders of the changes and to also encourage feedback. The loss of the innovative leader of Apple, Steve Jobbs created much anxiety about the new CEO Tim Cook. Stakeholders feared Cook would change the company and reject all Jobbs practices especially as the two leaders have different personalities. The media worsened the situation with continuous negative press coverage which resulted in a decrease in consumer confidence as well as Apple’s share price. Although Jobbs had planned to make some strategic changes to the company’s practices, he reassured stakeholders by stating that â€Å"Apple will not change†. He also identified these new strategies and their benefits in a press release which justified his decisions and satisfied stakeholders. The newfound trust of stakeholders will enable Apple’s cultural change to be easier and happen more quickly. In view of the above, I believe that it is not easy to change the culture of a business, as the current practices are custom to the organization; this also suggests that the change will be quite a process and therefore won’t be done quickly. This situation is worsened as the chief executive is new and won’t have the necessary knowledge and understanding of the business to enable a smooth and quick transition. However, the ability for the new chief executive to change the business’s culture quickly and easily is highly dependant upon the reaction of the stakeholders. For example, BP’s customers may react positively as the new culture will increase the company’s responsiveness to customers. Shareholders may also react positively as the increase of innovation should increase BP’s competitive advantage which could increase the company’s value and share price. However, the increase in innovation may pose a threat the employees as management will expect higher quality and the need for more qualified personnel may be necessary. Therefore, support from stakeholders will encourage an easier and quickly transformation whereas negativity will not. The skills of the workforce is also important as if they are innovative the cultural change will happen faster. However, Sony is in a creative industry and their strategy to increase innovation still took a long time. This suggests that attitudes and beliefs of the workforce are also important. An easy change is also depend upon the new executives approach, is it forceful or flexible? Being a senior registered nurse in a Hong Kong Hospital, it is part of my duty to teach the fellow nurses and nursing students. After I was entrusted to conduct a teaching session, I made thorough preparation to design the course content, the audiovisual aids, and hand out questionnaire to assess knowledge of the participants at the end of the session. The date of my session was scheduled to be on September 18, 2008. Report on the Session The session was held on September 18, 2008, in the hospital lecture theater. It was a well illuminated, spacious sound-proof room with state of the art and comfortable seating arrangement. There was a modern public address system, and the teacher is supposed to talk through it. The audiovisual head sets were available for each student, but since the group was large, all new headsets could not be arranged for all. At the end and also in the feedback form, quite a few of the students complained about disturbed hearing, and sometimes, they could not even follow the lecture (Bahn, D., 2001). There was a podium, where I was standing and talking, and the podium had been structured in such a manner that all students can have an equal view. There was computer set up in the room, an internet connection, and the computer was connected to an LCD projector. The functions of these were checked and rechecked before the session began so technical failure does not happen. I must accept that once on the podium, I was feeling a little shaky, by voice was dry, and was perplexed for a moment or two, not able to pick my words. However, I was careful to demonstrate openness of my personality, and in the introduction while setting my topic, I made it clear that we shall learn together. This broke the ice, and a healthy learning environment was set up immediately (Bastable, S., 2003). I also informed that whenever they think they are having difficulty following, they are welcome to stop me and ask questions, and I would heartily entertain them. The sexual and reproductive health is a significant part of a young persons life as adolescence is a time where an individual may choose to begin participating in sexual activity. The Young Australians: their health and wellbeing 2008 report profile found that 42.5% of young people in Year 10 and Year 12 have had sexual intercourse and around 45% of the sexually active students reported having more than one sexual partner in the past 12 months and both of these numbers have increased significantly since the previous survey in 2002. As a result of a higher sexual activity rate there has been a rising number of STI contractions. The survey found that 99.8% of young people in Year 10 and 12 used a form of contraception at their most recent sexual encounter and this number is showing a favourable trend. However, there are rising rates of notifiable sexually transmissible infections among young people aged 12-24 years largely chlamydia, with 1045 per 100,000 having a STI and 945 per 100,000 being chlamydia. This shows that although young people are using contraceptive methods they may not be using barrier methods to prevent STIs. Substance use The health behaviours of young people relating to drug use Physical activity The health behaviours of young people relating to physical activity have found to have unfavourable trends. The NSW schools physical activity and nutrition survey (SPANS) 2010 found that there has been a significant decline in the physical activity level of high school students, with an exception to year 10 girls. Only 56% of surveyed students met the recommended guidelines in summer and just over 50% in winter. Another finding of the SPANS in relation to physical activity was the significant proportion of young people participating in in small screen recreation (SSR) where over 60% exceeded the recommended guideline of 2 hours on weekdays, with this increasing to 80% on weekends. This sedentary behaviour in young people will ultimately increase level of health related disease in the future.

The Separation of Church and State in America Should NOT Be Absolute E

Religion is the most influential factor in human society. It is the core of our existence and has become a way of life in all cultures. The impact religion has had on the United States is overwhelming. This country was founded on the principle of Christianity. Thomas Jefferson drafted the Declaration of Independence, and James Madison articulated our countries' constitution with the belief that the Christian faith would establish and govern this great society. Merriam-Webster's online dictionary defines religion as, " any specific system of belief, worship, conduct, etc., often involving a code of ethics and a philosophy." (merriam-webster.com) This definition incorporates all individuals. All American citizens, acknowledging or not, are included in a belief system. Even atheism; belief if no God, is a form of religion. During the past thirty years or so, our country has seen a decline in the role of religion. With people casting shadows over their religion and putting their faith in separation of church and state, we have seen our country developing moral relativity. This moral relativity is dangerous ground. Most people are ignorant of their religion, not being able to give reasons for their belief. This religious illiteracy in America today has tragically developed the notion that separation of church and state should be absolute; thus creating a moral relativity which has had devastating impacts on our country. Religious literacy is something American citizens should explore and value. This literacy is the understanding of the beliefs of people; being able to justify one's religion through external evidences. Most Americans cannot do this. A research proposal on sporting and its personal development Essay

The usual playing adds little value to an individual. Sport, however, helps in the development of athletic as well as the physical abilities. Sports involve team work which adds value to the social context of an individual, the way of relationship with team members and how one perceives himself. The presence of a coach in a game helps in the control of various lessons that sportsmen learn in the field of play. The coaches help in the examination of values, designing of activities considering various results as well as leading through examples. This work will address various types of development related to sports including â€Å"physical, intellectual, social, and emotional as well as moral capabilities† (Barez 2008). Problem statement Different people have different opinions on sports and sporting activities. However, it is well known that sports lead to development of certain positive qualities including self discipline, dedication and leadership skills through the competitive participation in various events. On the other, a number of people also argue that sports do not have a positive result on character development due to the win ego. In this case, the mentality for a must win leads to unethical behaviors including excessive cheating, aggressiveness and drug abuse. This makes the real value of sports very complex and worth a discussion topic on this paper. However, the pros outdo the cons and the paper will discuss on sports as a development activity. Sports help in the physical development through balancing the mind, body as well as the spirit (Holt 2008). Literature review  In the early childhood as Bares (2008) states, sporting which is mostly in form of play helps in learning skills including running and jumping as well as balancing. This also helps in gaining and development of social, emotional, moral and cognitive competencies. This helps the children to learn the rights and the wrongs. As a result this develops the individual creativity in addition to the physical development (Bares 2008). In this case, winning is not the major factor but the child engages in sporting activities for fun, enjoyment and normal participation. In this case, success is contributed through fun and creativity. The participation in various roles under different games helps in stimulation of the child creativity and imagination. The children are in a position of exploring as well as interacting with the environment. This is in addition to testing their motor skills, interaction and solving of problem individually (Holt 2008). In the middle childhood, sporting becomes a regular activity for children. Sporting helps in development of confidence in various areas including â€Å"social, emotional, mental and physical aspects. † This helps them in mastering and neglecting the negative influences. Sporting at this level also help in cooperation and competition that are constructive. In addition, it works in the independence in solving conflicts and being responsible (Murphy 2005). During the early adolescent stage, the children experience various body developments and this could be coupled with emotional stress and instability. Sporting helps the teenagers to control their emotions and making of responsible choices. During sporting activities, the exchange of information helps in development of communication skills which helps them in expression and solving of problems (Barez 2008). Sporting helps in literal interpretation and respect where one learns to adhere to various rules. There is a schedule that must be followed for exercising and this works in building of responsibility where one should also be committed and able to persevere. During various competitions, sporting helps the teenagers to develop self control as well as respecting others where one is able to accept wins with humility as well as losing. Teammates are supportive and this with various other traits goes beyond the field to the individual ways of living (Murphy 2005). In the late adolescent, according to Barez (2008), sporting plays a major role where teenagers are involved in various decisions making including â€Å"personal relationships, higher education, vocational training and career activities. Various hardships like â€Å"unemployment, financial strains, career confusion, unsatisfactory work experiences and lack of family support† among others pose a great threat to individual life. Sporting helps in provision of increased levels of self esteem, perseverance and self discipline. Sporting helps in supporting self competence and independence. However, sporting in itself is also a career and work as source of income. Through sporting one establishes his personal goals as well as career objectives (Barez 2008). Conclusion  Sporting is a major part of personal life which helps in achievement of high life standards and expectations. First, sporting acts as a motivational tool which works in encouragement and development of effective learning methods. It helps one to have specific life goals and objectives by focusing on training goals which calls for self discipline and responsibility. One is able to work without supervision with consistency which calls for commitment for performance. One is able to undergo great perseverance and can approach problems with confidence.

Struggle for Individuality Essay

The autobiography, Black Boy, follows the life of Richard Wright and his experiences as a young African American teenager facing racism in the South. Throughout the novel, Wright focuses on the oppression society inflicts upon him. He finds difficulty in remaining employed because he does not act â€Å"black† or submissive enough. He is physically and emotionally attacked for being African American as the majority of the South contains an extremely racist culture. Wright does not even have his family to rely on for support because they criticize and beat him as well. Differences within his family along with incidences of violent attacks and disrespectful language plague Wright and try to deplete his confidence and identity. However, Wright simultaneously finds measures within these aspects to gain back his individuality and happiness. He fights back through violence to uphold his right of walking safely in Memphis; he uses all of his ability to avoid beatings from his family, and he finds joy and sense of worth when he writes stories. Ultimately, Wright struggles to keep his sense of identity in a society that degrades his persona, but manages to obtain his individuality in the end. Through violence, Wright begins to understand that society is laying out a persona for him to accept that is not initially his. In the South, he learns he must accept the role as the meek and respectful â€Å"nigger.† Wright experiences violence one day that teaches him how whites expect him to act in the South. Wright recounts, â€Å"The car stopped and the white men piled out and stood over me. ‘Nigger, ain’t you learned no better sense’n that yet?’ asked the man who hit me. ‘Ain’t you learned to say sir to a white man yet?’† (181). Wright is smashed between the eyes with a glass bottle when he does not answer a white man by â€Å"sir†. The repetition of questions from the white man illustrates the authority the white man feels over Wright. The white man questions Wright as if he is an uneducated child. His word choice of â€Å"sense† portrays that saying â€Å"sir† to a white man should be common sense. After this incident, Wright â€Å"[learns] rapidly how to watch white people, to observe their every move, every fleeting expression, how to interpret what was said and what left unsaid† (181). He treats and studies white people delicately to ensure that he does not upset the balance between the higher  citizen and lower citizen, and thus does not have to suffer their brutal consequences. As Wright learns he is unable to act naturally, society gradually shapes him into what it thinks he should be. Wright recalls, â€Å"all the violent expressions of hate and hostility that had seeped into us from our surroundings, came now to the surface to guide our actions† (83). Wright’s utilization of the â€Å"h† alliteration in â€Å"hate† and â€Å"hostility† emphasizes a heavy â€Å"h† sound to reinforce the thickness and greatness of their conflict, that their differences were not just on the surface, but blood deep. The â€Å"s† alliteration in the word, â€Å"seeped,† â€Å"surroundings,† and â€Å"surface† creates a low, rattling â€Å"s† sound to create a sense of savagery in their actions. As Wright grows, he begins to experience the segregation between white and black. He also begins to accept the role of an angry African American that society casts him to play. He learns that he must act as a quiet and obedient â€Å"nigger† as he is constantly beaten whenever he acts otherwise. Wright’s family also takes away his freedom to be himself as they consistently beat him. In one incidence, he tells of the time his Uncle Tom was infuriated with the way he speaks. His uncle says, â€Å"I never heard a sassier black imp than you in all my life† (157). Wright does not understand what he said or what he did wrong; yet his uncle is persistent in beating him, believing that Wright does not know how to live with people. Wright asks â€Å"How long was I going to be beaten for trifles and less than trifles?† (158). Wright’s questioning of time illustrates the weariness he feels toward his family. He cannot endure any more beatings over trivial matters. Because of his family members, Wright is trapped in his grandmother’s home. He is unable to speak freely as his family members find him impolite. The one place that Richard Wright should feel comfortable, if nowhere else, is his own home, but he is so alienated by his family that he cannot. Wright feels that the only way he can escape his mental imprisonment is by moving to the North, thus creating the North as a symbol of hope. Language functions as a powerful device that portrays white women attacking Wright’s individuality. When Wright searches for jobs and interacts with  white people for the first time, he experiences a double consciousness: how he views himself and how the white women view him. The language that white interviewers use is insulting and depicts how unintelligent they perceive him. After a few interviews Wright â€Å"quickly [learns] the reality- a Negro’s reality- of the white world† (148) as being thought of as dumb witted. The first woman illogically asks Wright if he steals to that white he thinks, â€Å"Only an idiot would have answered: Yes ma’am. I steal† (146). When Wright answers. â€Å"Lady, if I was a thief, I’d never tell anybody,† the lady bluntly states, â€Å"Now, look, we don’t want a sassy nigger around here† (145). The first interviewer seems to believe that black people do not have enough sense to lie abou t stealing, even when they are being interviewed for a job position. She considers a black person with common sense as a â€Å"sassy nigger.† The last interviewer finds it appalling that Wright cannot milk a cow as she mentions, â€Å"You mean to stand there, nigger, and tell me that you live in Jackson and don’t know how to milk a cow?† (149). She places Wright in the stereotype that all black boys from Jackson know how to milk a cow. The fact that she demanded an answer in surprise illustrates the disbelief she feels in finding one black person that cannot milk a cow. The white women stereotype Richard as an uneducated black boy with no level of intelligence and skill. They insult his knowledge and strip him of his individuality believing that all black boys are the same. The white women demean him causing him to leave every interview. The portrayal of the white women labeling Richard Wright as another dumb â€Å"nigger† illustrates how narrow-minded and similar they are to each other. Within Black Boy, language illustrates the racial resentment that the white women feel towards Wright for the color of his skin. Language acts as a device seizing Richard’s individuality and personal respect he obtains for himself. Although Richard Wright’s relationship with violence, family and language teach him that he was no power as an individual, Wright rebels and utilizes these same aspects in an effort to seek some sort of control. Wright’s mother is the first to offer him power through violence. Wright recalls, â€Å"I was baffled. My mother was telling me to fight, a thing that she had never  done before† (17). After Wright fights off a group of boys with a stick and delivers his mother’s groceries he says, â€Å"on my way back I kept my stick poised for instant use, but there was not a single boy in sight. That night I won the right to the streets of Memphis† (18). Although violence acts as a method to teach him of his lower social stance in society, he is able to gain personal power though this same violence. After bearing those boys, he is able to walk freely by himself in peace. In addition, Wright gains power within his family as he refuses to be whipped. After his Aunt Addie whips him in class for walnuts that another boy had left he says, â€Å"I was sure of one thing: I would not be beaten by her again† (107). Many times throughout the novel Richard’s family relatives endeavor to beat him, but he refuses and with that gains power over them and individuality because he will not let them lay a single hand upon him. Wright recalls, â€Å"Aunt Addie took her defeat hard [†¦] I was conscious that she had descended to my own emotional level in her effort to rule me, and my respect for her sank† (110). After Aunt Addie tried to beat him for a fault he did not commit and fails, he begins to feel that he is on the same level of an adult. Furthermore, Wright is able to obtain power and individuality again through language. When Richard is younger he writes a passage about an Indian girl; he says, â€Å"I had never in my life done anything like it; I had made something, no matter how bad it was; and it was mine† (120). Afterwards, Richard shows his written passage to his neighbor and â€Å"her inability to grasp what [he] had done or was trying to somehow gratified [him]† (121). Being able to write gives Richard a strong sense of individuality since it is his creation. Writing the passage also gives Wright a surge of empowerment, as his neighbor cannot fathom why or how he did it. Throughout Black Boy, Richard Wright is inhibited as a person. He is expected to act as a subservient African American. He is insulted and degraded for merely possessing a different color of skin. Wright is restrained by society and learns this oppression when he is violently beaten by white people as well as his family. Wright quickly learns how white people view him as inferior when they insult his intelligence and stereotype  him as a person that will never amount to anything. Richard Wright is constantly belittled as a person, but he uses these same aspects to gain back his power as an individual. He fights a range of people, from a gang of kids trying to take his money to his own family relatives, in order to keep his sense of power. He writes short stories that bring him happiness and confidence and respect. Black Boy offers the life story of Richard Wright’s battle against violence, family differences, and insulting language to uphold his individuality and freedom to be himself against all forces.
